PRESENTATION

We strongly recommend that you read all of these General Usage Conditions before consulting the site.

These General Usage Conditions are intended to define the conditions for accessing and using the "www.sncf.com" site (hereafter referred to as the "Site").

A Site User (hereafter referred to as the "User") is defined as anyone who connects to the Site. You are currently connected to the "sncf.com" website, which may be accessed at the following address: "www.sncf.com" (hereafter referred to as the "Site").

The Site is published by SNCF, an Industrial and Commercial Public Establishment, registered with the Bobigny Registry of Commerce and Companies, under the number B.808.332.670.

SNCF reserves the right to modify or update these General Usage Conditions at any time without the User's prior agreement.  Therefore, users are recommended to refer regularly to the latest version of the General Usage Conditions, which is permanently available on the Site.


SUBJECT

The purpose of the Site is to provide information and assistance about all SNCF Group activities, products, services and offers.


ACCESS

The Site is accessed in particular from a computer, a telephone, a personal assistant or a mobile terminal connected to a telecommunications network according to the communications protocols used on the Internet network.
The User is informed of the cost of the access and browsing around the Site is at their own expense.


SERVICE AVAILABILITY

The Site is accessible 24 hours a day, 7 days a week, except in the event of an Act of God or an event which is outside SNCF's control.

However, an interruption for technical maintenance or an update necessary for the Site and related equipment to function or for any other reason may be decided by SNCF; this access to all or part of the Site may then be suspended without the User being informed in advance.

SNCF is not bound by any obligation for results concerning the Site's technical accessibility. Under no circumstances is SNCF responsible for any interruptions or the consequences they may have.

The User is informed that SNCF may end or modify the characteristics of the services offered on the Site at any time, without notice and without the User having any recourse in relation to SNCF.


LEGAL INFORMATION

To enable the site to operate correctly, certain technical constraints must be respected by Users; these are likely to be modified.

The User is bound to respect the following technical indications to be able to access the Site and use the services proposed in the best way. They are prohibited from carrying out any action likely to hinder or interfere with the proper operation or technical accessibility of the Site. The following minimum configuration is required to access the Site:

Browsers minimum: IE 7, Safari 2, Firefox 2, Mozilla Firefox

Users undertake to use equipment which does not contain any viruses to access the Site.

SNCF does not guarantee that its servers which host the Site are free of viruses and other dangerous components. Therefore, the User must take all appropriate measures to protect their own data and/or software from contamination by any viruses which circulate on the Internet network.

The User accepts the fact that SNCF can not be held responsible under any circumstances for any unforeseeable material and/or non-material, direct and/or indirect damage which may result from access to or use of the Site, including inaccessibility, data loss, damage, destruction or viruses which may affect the User's IT equipment and/or the presence of viruses on their Site.

In addition, any material which is downloaded and/or obtained, in any way, when using the Site is at the User's risks and perils. In no way is SNCF responsible for any damage and/or data loss to which their computer is subject.


USAGE

Use of the site is reserved for strictly personal use, except where specified by SNCF. In particular, the User is prohibited from the following, without this list being exhaustive:

  • Using the site for commercial purposes and in general from proposing products and services with direct or indirect remuneration;
  • "Reselling" or providing to third parties and/or other Users the content of the Site, whether for a fee and/or
    free of charge;
  • Using the site to send advertising or unsolicited promotional elements in any way;
  • Directing Internet users directly or indirectly, in particular via hypertext links, to other Internet sites which are likely to not respect these General Usage Conditions.

INFORMATION PROPOSED

The information published by SNCF and contained on the Site is non-contractual and provided for information purposes, free of charge, and with no obligations on SNCF, which may modify it without notice.

SNCF strives to provide information which is as accurate as possible on the Site. However, SNCF may not be held responsible for any update omissions, incorrect information or missing information, whether by their own fault or by the fault of partner third parties who provide it with this information. The User is invited to check all information distributed on the Site with official sources.

Users are provided with interactive spaces. However, SNCF reserves the right to remove without prior warning all content deposited in this space which contravenes applicable legislation in France, in particular data protection provisions. Where applicable, SNCF also reserves the possibility of calling into question the User's civil and/or criminal responsibility, in particular in the event of racist, insulting, defamatory or pornographic messages, regardless of the medium used (text, photograph, etc.).


INTELLECTUAL PROPERTY

In general, the User is prohibited from causing any harm to the intellectual property rights (copyright, neighbouring rights, database producer sui generis rights, brand rights, domain names, etc.) of SNCF and/or third parties.

SNCF holds all intellectual property rights, both to the structure and the content of the Site (texts, logos, images, sound elements, software, icons, page layout, database, etc.) or has regularly acquired the rights to enable the Site's structure and content to be operated, without any limitations.

SNCF grants the User the right to use the Site for their own strictly private use, to the exclusion of all profit-making use. In the event of professional use, the User must obtain express prior written authorisation from SNCF.

Therefore, the User may not carry out any reproduction, representation, adaptation, translation, partial or full conversion or transfer of Site elements, in any way and for any purpose, except where express prior written authorisation is granted from SNCF.

The downloading by the User of certain elements, in particular texts, photographs or music, may be authorised by SNCF. This functionality is at the complete discretion of SNCF, who may modify or remove it at any time. Consequently, the User undertakes not to launch any dispute against SNCF in this area. In addition, the dispute of an unauthorised download may lead SNCF and/or any third party concerned to take the appropriate sanctions, in particular if intellectual property rights are violated.

The marks and logos reproduced on the Site are registered by the companies who own them. Any reproduction of the names or logos in any way without prior authorisation from the owner concerned is prohibited.

Failure to respect these restrictions may constitute an act of counterfeit and/or illegal and interfering competition, invoking the User's civil and/or criminal responsibility.

Hypertext links

  1. Except for sites which distribute illegal and/or political, religious or pornographic content, a User may create a hypertext link to the Site from another site. If these sites are used, the User is invited to refer to the General Usage Conditions for the site concerned. Under this authorisation, SNCF reserves an opposition right and is free of any responsibility as to the information contained in these sites which may be linked to its own Site via a hypertext link or other method.
  2. On the other hand, hypertext links contained on the Site may link to other websites by any method. If SNCF is unable to check these sites and these external sources, SNCF cannot be held responsible for the provision of these sites and external sources and cannot bear any responsibility for the content, advertising, products, services or any other material available on or from these external sites or sources. In addition, SNCF may not be held responsible for any noted or alleged damage following or in relation to the use of or having trusted the content of goods or services available on these external sites or sources. Finally, within the limits authorised by law, SNCF cannot be held responsible if the content of these other sites contravenes current legal and regulatory provisions.

COOKIES

Browsing the Site is likely to lead to the installation of cookies on the User's computer.
A cookie is a small file which does not enable the User to be identified but which records information about how a computer browses a site. The data obtained in this way is intended to facilitate later browsing on the site and is also intended to enable different visit measurements to be taken.

However, the User is informed that most Internet browsers allow users to oppose the recording of cookies, to receive a warning message before a cookie is copied or to delete the cookies from their hard disk. The User must refer to their browser's instructions to find out more about these functions.

However, if the User opposes the installation of cookies or deletes them, their use of the Site may be altered or even impossible.


PERSONAL DATA MANAGEMENT

SNCF may be required to gather certain information about Users.

SNCF respects the private lives of Users and all personal data that the User is required to send to the Site is subject to the provisions of law No. 78-17 of 6th January 1978, the "IT and liberties law". 

In certain cases, SNCF may also be required to use data collected as part of professional communication.

The body in charge of processing this data is the SNCF Communication Department.

The end purpose of the Site is, without this list being exhaustive, to enter into contact with surfers for various subjects via interactive discussion areas, chats, games, competitions, newsletters, answers to surfers' questions and to enter into contact with Users for recruitment via application forms.

The data collected on the site is intended for SNCF's Communication Department.

SNCF does not collect any personal data about the User except for data which the User has intentionally recorded.

Certain information which is requested and is marked with an asterisk is required to process Users' requests. Other information, which may be supplied optionally by the User, is intended to know the Users better and to improve the quality of the service offered to them.

SNCF will not be able to deliver the User the information they request if they do not provide an answer to the compulsory information for which they are asked.

Conservation of personal data

  1. In relation to the Site as a whole, SNCF holds and keeps all administrative (surname, first name, etc.) and connection (IP address, connection date and time) data to enable the people who make Contributions to it to be identified. Users are reminded that they undertake to provide exact and not pretend information about their identity. Under no circumstances may this information be used for commercial purposes and and will only be communicated to relevant authorities who request it. Therefore, SNCF provides a storage service for all information, without intervening actively on its content. This data will be destroyed at the end of the processing in question or at the request of a User.
  2. Concerning the areas related to employment and recruitment, the personal data will be kept for the full lifetime of the account on the Site and in the internal base for 2 years for candidates who are not recruited and for candidates who are recruited for 3 years after they leave their position, in accordance with the provisions of decree EQTU03001007A of 30/07/2003. The data is intended for the Human Resources Department's Recruitment Departments and, if you are recruited, the Human Resources Manager for the structure to which you are assigned and the consulting psychologists.  SNCF may entrust the processing of CVs to a sub-contractor who undertakes to implement all the necessary measures to ensure the confidentiality, integrity and security of the personal data.
  • Certain information which is requested and is marked with an asterisk is required to process applications. Other information, which may be supplied optionally by the user, is intended to know the candidates better and to better target their profile with recruitment requirements. If you do not provide a response to the compulsory information which is requested, SNCF will be unable to take account of your application.
  • Certain data which is collected concerning education, diplomas, professional experience, languages spoke and permits and authorisations may be the subject of automated decision-making assistance processing to determine whether the application matches the profile sought and defined by =SNCF.

Right to access, oppose, rectify and delete personal data
 
The User is informed that they have the right to access, oppose, rectify and delete their data in accordance with law No. 78-17 of 6th January 1978, the "IT and liberties" law.

Therefore, they may demand that any information about them which is incorrect, incomplete, equivocal, out of date or whose collection or use, communication or conservation is prohibited be rectified, completed, clarified, updated or deleted.

SNCF will do everything in its power to make the changes requested as quickly as possible.

Concerning the areas related to employment and recruitment, anyone who wants to access this right to access, modify, rectify, delete and oppose their personal data must send their written and signed requested accompanied by a copy of their identify document with the holder's signature, specifying the address to which the response must be sent.

In any case, this data remains strictly confidential. SNCF undertakes not to communicate the User's data to any third parties, except where expressly authorised by them.


GUARANTEE & COMPENSATION

When using the Site, the User undertakes not to contravene the current legal and regulatory provisions, Netiquette usage and these General Usage Conditions. The User is informed that any violation of these provisions is likely to lead to legal proceedings and sanctions against them.

In general, SNCF is free of any responsibility in the event of usage which does not conform to the General Usage Conditions and their services.

The User undertakes to act diligently to answer any claim. The User is responsible to SNCF and/or third parties for any material and/or non-material, direct and/or indirect prejudice of any kind whether caused by them and/or their representatives in the event of non-conforming use. The User guarantees SNCF and its parent, sister or affiliate companies and its representatives, employees and partners against any demand, complaint, claim and/or recourse of any kind which results from any violation of these provisions.

The User will compensate them at any time and at their first request against and damage and/or against any demands, actions or complaints from third parties resulting from any violation of these provisions. This guarantee covers all damages and interest which may be paid, regardless of their direct or indirect origin, as well as lawyer's fees, expertise expenses, justice costs and fiscal fees.


MISCELLANEOUS PROVISIONS

The invalidity in whole or in part of one or more of the provisions of these General Usage Conditions, under the terms of a legal or regulatory provision or a legal decision that has become definitive does not lead to the invalidity of the other provisions or the part of the provision that is not invalid.


APPLICABLE LAW
& ASSIGNMENT OF JURISDICTION

These General Usage Conditions are subject to French law.

Any dispute relating to the interpretation or execution of these General Usage Conditions will be submitted to the competence of the relevant French courts.

IDENTITY AREA

The Identity Area is a zone on our Site which may be accessed from the Group part ("Our Identity" entry in the Site's navigation remote control) or directly from the address http://www.sncf.com/fr/identite (hereafter referred to as "the Area"). The Area is intended to provide information and visual assistance about the SNCF brand, its visual and sound identity, its use and its application rules. The Area also enables the User to download certain SNCF brand visual and sound identity components for strictly professional use according to the rules defined below and according to the usage and authorisation granted by SNCF, in particular when a media library is accessed.
The provisions of these General Usage Conditions apply in full to the Area. However, due to the specific nature of the Area, they are competed or modified by the following:

1.    Use of the Area
The Area is reserved for strictly professional use. Except where prior written authorisation is received fro SNCF, the User is prohibited from the following, without this list being exhaustive:

  • Using the Area for commercial purposes and in general from proposing products and services with direct or indirect remuneration;
  • "Reselling" or providing to third parties and/or other Users the content of the Area, whether for a fee and/or
    free of charge;
  • Using the Area to send advertising or unsolicited promotional elements in any way.

2.    Authorisations to access the Area

The Area is accessible to all Users. However, access to certain sections of the Area is restricted to Users with authorisation and who have previously identified in the zone provided for this purpose (hereafter referred to as "the authorised Users").
Three (3) degrees of access have been provided for access to the restricted sections of the Area according to the authorisation rights granted by SNCF:

  • Authorised external: access limited to certain sections of the Area, subject to a justified registration request, submitted for prior agreement by an internal SNCF agent, and then validated by SNCF's Communication Department; this validation is at its full discretion.
  • Authorised SNCF employee: full and automatic access to all sections of the Area as an employee of SNCF or one of the Group's companies. This access is automatic and does not require any registration if they have an account in the SNCF RID base (Digital Identity Reference Base).  This access requires registration which is validated automatically if they have an electronic address from a domain in one of the Group's companies. In other cases, they must make a registration request to SNCF's Communication Department.

a) Registration procedures / authorisation requests / Renewal

To make a registration or authorisation request, the User must connect to the Area and fill in the form which may be accessed from the identification zone ("Create an account").
The User is informed that responses are compulsory for fields marked with an asterisk (*) whereas the other responses are only optional. Any insufficient responses will be ignored.
A User who does not have an RID account guarantees SNCF that they have provide exact, not pretend, up to date and complete information, in particular in relation to their identity and details.
They also undertake to update regularly all data that relates to them in order to guarantee its veracity; this is in their own interest, given the end purpose of the Area.
The User is informed that SNCF may check the registration forms and cancel the User's account if any wrong or intentionally false information is found.
For an external authorisation request, this must be justified, connected and validated by an internal contact. Once the request has been made, SNCF reserves the possibility of validating, refusing, limiting or removing the User's authorisation, of full right and with no prior justification.
The User who receives external authorisation is expressly informed that their authorisation is valid for a duration determined by the SNCF agent of a maximum of one (1) year, starting from the date when their request is validated by SNCF's Communication Department. The authorisation may be renewed at the User's request from their personal account management zone ("Manage my account").
Authorised SNCF employees who do not have an RID account are expressly informed that their authorisation is valid for one (1) year from the registration date. The authorisation may be renewed for a period of the same duration at the User's request from their personal account management zone ("Manage my account").

The User is also reminded that SNCF's Communication Department is the only body which may grant authorisation to a User. SNCF's Communication Department reserves the right to refuse a registration for any reason and without any possible recourse from the User.
The authorised User may decide to remove their authorisation at any time. They must then request this by sending an electronic mail to the following address: identite-marque@sncf.fr
Finally, authorised Users who do not have an RFID account are obliged to update regularly all the data relating to them and to notify SNCF as soon as possible, in particular in the context of their departure from SNCF, its subsidiaries, the end of an internship or work placement or departure from companies working on behalf of SNCF. This notification must be sent to the following electronic address: identite-marque@sncf.fr.

b) Password and identifier

For authorised Users who do not have an RID account, an identifier (electronic mail) and a password which may be configured and modified freely at any time enable the authorised User to access the restricted sections.  The authorised User's identifier and password are strictly personal, confidential and non-transferable.  The authorised User is the only person responsible for keeping their password and identifier secret. They are also responsible for all access to the Area made using their identifier and password, except where fraudulent use is proven. 
In the event of loss, misappropriation or fraudulent use of their identifiers and password by a third party, the authorised User undertakes to alert SNCF immediately by electronic mail to the following address: identite-marque@sncf.fr, specifying their identifier. If fraudulent use of the password is noted, SNCF will contact the User to find a suitable solution with them.
If the User forgets their password, there is a password reset procedure to enable authorised Users who do not have an RID account to regain the use of their password. This procedure supposes the statement of the identifier and use of the electronic address communicated by the authorised User during their authorisation request.
For authorised Users who have an RID account, resetting the password requires the procedures put in place by SNCF to be followed.

3.    Intellectual property

The provisions in these General Usage Conditions are completed as follows for the use of the Area:
The authorised User is entitled to use the information and content published in the Area's sections which may only be accessed by authorised Users for their professional requirements only All other use is strictly prohibited.
SNCF may also delete one or more elements of content from the Area for any reason (expiry of rights, claim by a third party, etc.) and without needing to alert the authorised User first. Any claim based on the withdrawal or modification of content will not be considered as valid.
In addition, subject to certain rights they are granted, if certain elements are used, in particular sound or visual elements, which are downloaded to the Area, the User undertakes to mention the name of the rights holder and the source on each communication medium. For the elements which are downloaded from the media library, this information appears in the contact panel which is displayed when the download starts.  The User is also bound to respect the usage conditions which are specific to each content. If they fail to do so, SNCF may not be held responsible for any incorrect use of the elements.
In addition, it is prohibited to reproduce, represent and/or modify in any way and for any purpose all or part of the structure and content of the Area, except where express prior written agreement is obtained from SNCF. Therefore, the User is not authorised to reproduce, represent, adapt, translate, convert partially or in full or transfer Area elements to another website or any other medium.
The provisions relating to hypertext links to the Site are also modified as follows:
The insertion of hypertext links by th User to any part of the Area which may only be accessed by authorised Users is prohibited, except where prior written authorisation is obtained from SNCF.
The other provisions relating to the hypertext links contained in the Area remain unchanged.

4.    Personal data management / Provisions relating to authorised Users

SNCF - Communication Department has electronic resources that enable the personal data of authorised Users to be collected in order to manage User authorisations and their subscriptions to newsletters.
SNCF - Communication Department respects the private lives of Users and all personal data that the User is required to send to the Area is subject to the provisions of law No. 78-17 of 6th January 1978, the "IT and liberties law".
The processing of personal data using the data collected on the Area has been declared to SNCF's IT and Liberties Correspondent, under acknowledgement number D11.037.V.M01.
The information recorded is reserved for use by the departments concerned and is only communicated to the following recipients:

  • SNCF - Communication Department;
  • Voyages-SNCF Technologies
  • SNCF - Internal agent, where applicable

SNCF does not collect any personal data about the User except for data which the User has intentionally recorded.

Personal data conservation

Right to access, rectify, oppose and delete personal data:
In accordance with articles 39 and following of the law of 6th January 1978 relating to IT, files and liberties, the authorised User may exercise their right to access, rectify, delete and oppose the processing of their data by sending an electronic mail to the following address: identite-marque@sncf.fr or by letter to the followign address: Pôle Identité de Marque et Design, 2 place aux Etoiles, CS 70001 93633 La Plaine Saint-Denis, Cedex.  SNCF will do everything in its power to make the changes requested as quickly as possible.
However, the authorised User is informed that their registration will not be validated if they oppose the collection of their personal data. If the authorised User requests the deletion of this data while their authorisation is active, their authorisation will be cancelled automatically.
In any case, this data will remain strictly confidential. SNCF undertakes not to communicate the authorised User's data to any third parties, except where expressly authorised by them. This information may be communicated at the request of a legal authority.
Personal data security:

SNCF undertakes to provide its best efforts to implement the technical and organisational measures to protect personal data. Nevertheless, the authorised User declares that they are fully informed of the characteristics and constraints of the Internet network and that the data which travels over this network is not protected against all forms of intrusion, including piracy. The authorised User recognises that it is impossible to guarantee total security for the data transmitted over the network and that under no circumstances may SNCF guarantee the confidentiality, security or integrity of any information transmitted over the Internet. Consequently, SNCF may not be held responsible for any incidents which may follow this transmission. The authorised User must implement all useful resources to preserve the confidentiality of the information transmitted over the Internet. Authorised Users are therefore recommended to handle their personal information with a great deal of care.
For all useful purposes, authorised Users are reminded that they communicate this information at their own risk and peril.
